Update as of 1/13/18:

On January 13, 2018, the United States Citizenship and Immigration Services resumed accepting renewal requests for DACA following a federal court order. DACA will still continue to function as it did prior to President Trump canceling the program on September 5, 2017.

Of note in the updated DHS announcement are the following:

  • Individuals previously granted DACA but had their deferred action expire on or after September 5, 2016 may request a renewal
  • Those individuals previously granted DACA that had their deferred action expire before September 5, 2016 may only file a new initial request (when filing a new initial request, list the date of expiration)
  • Those individuals previously granted DACA that had their deferred action terminated at any time may only file a new initial request (when filing a new initial request, list the date of termination)
  • Applications for individuals who have never been granted DACA will not be accepted at this time
  • Advanced Parole requests (mentioned earlier in this post) will not be accepted at this time

DACA Program to be Renewed

On January 9, 2018, the Department of Homeland Security made an important announcement. It ruled that part of the DACA (Deferred Action for Childhood Arrivals) program will be kept alive. The program will continue running as it once did, but with the following exceptions as of the January 2018 announcement:

  • New applications will not be processed
  • Advanced Parole will also not be processed, but the US DHS will be accepting DACA renewals

However, it is important to wait to submit renewal applications until more concrete information detailing the guidelines is released by the United States Citizenship and Immigration Services.
